On 4 December 2015, the President of Ireland signed the Residential Tenancies Amendment Act 2015 into law after the Minister for the Environment, Alan Kelly, had reported on 2 December 2015 that the legislation had passed both Houses of the Oireachtas. The following provisions of the Amendment Act came into effect immediately:
- A temporary prohibition on conducting rent reviews more often than once in every two year period;
- The notification period before a new rent can take effect has been increased from 28 days to 90 days.
- An expanded scale of notice periods for the termination of tenancies where there has been occupation of between 4 and 8 years.
The remaining provisions, including the introduction of a deposit protection scheme and the expansion of the Private Residential Tenancies Board’s remit to include not-for-profit Approved Housing Bodies will be commenced at a later date. Once the text of the amending legislation as enacted becomes available, we will analyse it more fully here.
