The High Court recently held in favour of South Dublin County Council (SDCC) in claim by a 9 year old who injured his knee while playing on a football pitch maintained by SDCC. The Plaintiff injured himself on some broken glass which was on the pitch. The High Court recently held in favour of South Dublin County Council (SDCC) in claim by a 9 year old who injured his knee while playing on a football pitch maintained by SDCC. The Plaintiff injured himself on some broken glass which was on the pitch. The Court held that the Plaintiff was a recreational user under the Occupiers Liability Act 1995 and that SDCC was not in breach of its duty of care to the Plaintiff and did not act towards to the Plaintiff with reckless disregard. The claim was dismissed on this basis and on the basis that SDCC had a system of management in place in relation to the pitches.
