The UK High Court has considered the power of a Regulatory Body to refer back to its Investigating Committee new allegations arising from the same facts as allegations that already been considered and referred by that Committee.
In this case the Investigating Committee decided that they had jurisdiction to consider new allegations referred to them by the regulator where these new allegations arose out of the same or substantially the same facts as those from which the previous set of allegations had arisen.
This is an interesting case, in that the Court clarified that an Investigating Committee can have the jurisdiction to consider additional referrals made to it by the regulator.
