The Supreme Court has ruled that the Garda Síochána Ombudsman Commission can proceed to investigate a complaint made by a member of the public that was not brought within the six month of the incident, as required by the Garda Síochána Act 2005 (the “2005 Act”).
The unanimous five judge court overturned a decision of the High Court prohibiting the investigation.
The Supreme Court ruled that the 2005 Act cannot be interpreted as imposing a general limitation on an investigation if not initiated within six months. This is particularly so when the GSOC has indicated that an investigation is desirable in the public interest as provided for in the 2005 Act.
