£2.25m+ for young woman left blind following delayed diagnosis of optic nerve glioma

Claire Horton has secured significant damages on behalf of her client Eve* who lost her sight as a teenager after multiple failures to diagnose optic nerve glioma. She also suffered a permanent peripheral nerve injury (reduced feeling in her hands and feet) from the chemotherapy she underwent to treat the tumour.

Eve instructed Claire in a medical negligence claim against several defendants. The NHS Commissioning Board (NHSCB), responsible for the treatment provided at Rusholme Health Centre and Withington Hospital Community Clinic, finally accepted a 95 per cent liability agreement for Eve's loss of sight.

NHSCB, University Hospitals Bristol NHS Foundation Trust and Plymouth Hospitals NHS Foundation Trust then accepted 95 per cent admission of liability, for the peripheral nerve injury, avoiding the need for trial.

At a joint settlement meeting, a lump sum of £2.25m damages was agreed, which will provide for the ongoing therapy, equipment and support Eve needs and enable her to live a fulfilling and independent life, plus an additional £35,000 per annum for a personal assistant for as long as required.
