Chris, 67 at the time, had a family history of haemophilia, which, it was alleged, was disclosed to the Defendants prior to surgery. During the weeks following knee surgery, Chris' wound continued to bleed excessively, he complained of significant pain and swelling and blistering around the wound.
Despite his ongoing symptoms and a doctor suggesting a test for haemophilia, no such checks were performed for at least a month, by which time it was too late. In spite of further treatment over the next few months, the Claimant's right leg had to be amputated above the knee.
Experts in orthopaedic surgery and haemophilia prepared reports before Court proceedings were served on the Defendant, which admitted in its defence that the management of the Claimant's condition was negligent post-operatively which led to him requiring his amputation.
An interim payment was immediately obtained to enable Chris to purchase private prosthetics, appoint a case manager and employ a team of carers to assist him. Reports were obtained from experts in 12 different disciplines to fully quantify the claim.
The parties agreed to meet at a mediation earlier this year to attempt to settle the claim, but we did not believe the Defendant's offer suitably compensated Chris for this injuries. At a separate settlement meeting soon afterwards, the Defendants, having obtained their own care expert report that agreed that Chris required live-in care increased the offer to in excess of £2m. The offer was accepted.
Following settlement, Chris said:
