£3.5 million settlement after Deliveroo coordinates help prove driver’s journey

Ali sustained a serious traumatic brain injury and a traumatic stroke, resulting in left-sided weakness. He also suffered complex musculoskeletal injuries to his shoulder, spine, and femur, all of which required surgical intervention. He spent time in the ICU and over a month in hospital before being discharged to the care of his brother and wife.

Eman was instructed to pursue a claim and working with Ruth Kettle. Initially, the insurers disputed liability, alleging that Ali had been driving on the wrong side of the road. While liability remained in dispute, there was very little provided to the client by way of rehabilitation or financial support.

Eman obtained independent witness statements and obtained GPS coordinates from Deliveroo that mapped Ali’s route home and confirmed he had been on the correct side of the road. The criminal trial took place alongside these investigations whereby the driver was convicted. Following this, the insurers admitted liability.

Eman promptly appointed a case manager who arranged for Ali to receive inpatient treatment at the STEPS rehabilitation centre in Sheffield for 12 weeks. With the case manager's support, they secured funding for an Airbnb nearby for Ali’s brother and wife during his treatment. The case manager pulled together a comprehensive rehabilitation package for his return home, including neuropsychology, neuropsychiatry, physiotherapy, occupational therapy, and ongoing support from rehabilitation assistants.

Funds were also secured to source alternative rented accommodation, as Ali’s pre-accident home was no longer appropriate. Sadly, after leaving rehab, Ali's marriage broke down. As he was in the UK on a spousal visa, his immigration status was at risk.

Fieldfisher’s immigration team took on Ali’s case and successfully secured indefinite leave to remain enabling him to confidently settle his divorce

Ali continues to lack financial capacity, and support is ongoing from Fieldfisher’s Court of Protection team, including Robin Tubbs and Jordan Tucker.

In his home country, Ali was in training to be a lawyer, and he had been accepted on a post-graduate degree in International Business Law in the UK. Following the collision he is not able to pursue this career.

Eman and Ruth submitted various expert reports, and a settlement was reached at a Joint Settlement Meeting with the assistance of Counsel, Shahram Sharghy from 1 Crown Office Row with a collaborative defendant team. A £3.5 million settlement was approved at an approval hearing.

The damages will enable Ali to move into permanent, adapted accommodation and fund the ongoing therapies he needs to rebuild his life, including physiotherapy, neuropsychology, occupational therapy and continued assistance from his Rehabilitation Assistants.
