£370,000 for cyclist who suffered foot injury in crash

A blue bicycle lies on its side in the middle of a crosswalk, with a car parked nearby in the background.

Claire Glasgow settled the claim on behalf of her client Tina*, who was cycling home when she was hit by a motorist who failed to give way on a roundabout.

The car knocked Tina on to her right-hand side, seriously injuring her right leg. She was taken to Poole hospital by ambulance and underwent orthopaedic surgery.

Tina sustained a complex fracture to her right tibia involving her knee. Her surgeon advised her that it was '6/6' severity and it was repaired with metalwork. A torn artery was identified three days later, and she required vascular surgery to repair this. Unfortunately, she developed a right foot drop because of either the injuries or the surgery she later required.

After the accident Tina, who is in her early 30s, developed anxiety regarding roads and getting back on her bike and was treated by a clinical psychologist.  She had further surgery to her leg a year after the crash to try and improve her movement and control of her foot and reduce the foot drop. This left her immobilised and non-weight bearing for 6 weeks and she underwent a period of physiotherapy for the first 6 to 12 weeks.

Tina's foot drop is an ongoing issue, and she still cannot actively pull her foot up to 90 degrees. She is committed to recovery and regularly goes out on an e-bike, to the gym and yoga classes, but she struggles to do certain exercises as her foot leans to one direction and she is unable to keep it flat on the floor.

She works as a librarian but had to take time off work following the accident. She was due to interview for a new job a few days after the collision, but due to her injuries she was not able to attend this and withdrew herself from the role.

Claire was instructed in a personal injury claim against the driver's insurer and secured private rehabilitation (funded by the insurer) and interim payments, which supported Tina while she could not earn. The claim settled and Tina received a total of £370,000 in damages, which will help to support her as she rebuilds her life following the collision.

Tina said following settlement:

"Claire and her team have been phenomenal. They have been thorough and meticulous, responsive, empathetic and understanding, proactive and did a brilliant job with my case, from beginning to end.

"I have been thoroughly impressed with how they handled my case and grateful to have been recommended them. I could not have wished for a better team and better care. Thank you all very much for all your hard work!"
