In 2021, Andrew Morgan settled a claim for Mr C, who was suffering from mesothelioma, on the basis that he could come back to court for an additional payment if he needed privately funded medical care in the future, including immunotherapy.
Mr C was doing well on conventional treatment until the summer of 2024, when his treating oncologist informed Andrew that Mr C's mesothelioma had advanced and that there were other complications. Privately funded dual-agent immunotherapy was now recommended as soon as possible, with £20,000 required in advance to prevent a delay in treatment.
Andrew immediately wrote to the insurer who had settled the original claim and explained the urgency of the case, saying that funds were needed within seven days otherwise Mr C's treatment would not start on time.
The insurer replied saying they would abide by the original settlement agreement. They arranged to pay £20,000 directly to the healthcare provider to avoid delay. They also agreed to continue making those payments directly to the healthcare provider for as long as required.
Due to Andrew's quick intervention, the agreement to fund the immunotherapy was reached with the insurer within 24 hours and the funds were paid to the healthcare provider within seven days, meaning Mr C's fully funded treatment could start on time and without him having to make any payment on account to his own funds.
Mr C continues to do well with his treatment.
