Agreement with MIB for Bangladeshi national horrifically brain injured by driver involved in police car chase

Jennifer Buchanan and Eman Hassan reached settlement with the Motor Insurance Bureau (MIB) of more than £1m for a man left with a traumatic brain injury after a car involved in a police chase ploughed into his motorcycle.

40-year-old Mr S*, originally from Bangladesh and granted political asylum in the UK, was travelling back at night from his job as a waiter in Ilford when a Volvo travelling at speed on the wrong side of the road ploughed into him.

Mr S was taken by Air Ambulance to the ICU at the Royal London Hospital with horrific and life-threatening orthopaedic fractures and injuries and a serious brain injury. He spent six weeks in hospital undergoing multiple surgeries.

The driver of the car denied he was driving at the time of the collision and the police failed to prosecute him. As such, the MIB was responsible for the case under the Untraced Drivers' Agreement. Jennifer took over Mr S's claim from another firm of solicitors which had failed to progress it.

Mr S was eventually released home to be cared for by his wife, who also looks after their two children. Mr S was effectively bed bound for six months and needed care with every aspect of daily life. His wife, also from Bangladesh, was pregnant with their second daughter at the time.

Mr S was left with amnesia and, according to his wife, experiences bad headaches and becomes irritated and short-tempered. The family were living at the time in a one-bedroom flat that was wholly unsuitable to Mr S's injuries. Although to begin with family and friends helped, this waned after several months.

Mr S was in pretty much constant pain and could only mobilise short distances on crutches. He is very unlikely ever to be able to work again and he and his wife were very concerned about their finances. His wife found it incredibly difficult to cope with Mr S's full time care while also looking after a child and a young baby. Mr S was left with severe anxiety and depression as well as chronic physical injuries as a result of the collision.

Once Jennifer took over Mr S's claim, a full rehabilitation package was put in place for Mr S to ensure that he had the maximum rehabilitation to maximise his recovery. Medical experts to give evidence about the extent of his injuries. As part of a tight-knit Bangladeshi community, Jennifer also worked hard to gain the trust of Mr S and his family.

Jennifer and Eman also had to battle with the MIB to properly compensate Mr S for his injuries but refused to give up. Eventually, the case settled for over £1m, desperately needed funds to help with Mr S's ongoing medical needs and to put in place the right care for him and his family.

The settlement has also funded appropriate accommodation locally to enable Mr S to live his most fulfilling life.
