Compensation for Labourer in Asbestosis Claim against Tate & Lyle

Dushal Mehta was instructed by Mr Alfred Walker in respect of his claim for asbestosis.

Mr Alfred Walker was employed as a warehouse/general labourer working at Tate & Lyle's premises at the Plaistow Refinery from the age of 16. He subsequently worked at the Thames Refinery. There were extensive systems of pipework and vats at the refineries all lagged or insulated with asbestos. Mr Walker spent much of his time near the laggers whilst they were removing the asbestos, including sweeping up around them. he was not given a mask to protect him from the dust.

Mr Walker developed asbestosis and bilateral pleural plaques. The asbestosis was causing Mr Walker great difficulty with his breathing and he was unable to walk 100 yards at a normal pace or walk up stairs without difficulty and needing a rest. He was assessed as having a 60% respiratory disability. His condition quickly deteriorated towards the end of 2011 and Mr Walker became totally dependent on his wife Margaret.

The insurers for Tate & Lyle were unwilling to accept liability for the claim and therefore we had to issue court proceedings to resolve Mr Walker's claim. After proceedings had been brought in the High Court, the Defendant's made an offer to Mr Walker which he was happy to accept. The compensation provided some financial security to cover Mr Walker's care needs.

Mr and Mrs Walker said "we were able to call Dushal whenever we needed to regarding the case, and are very satisfied with the excellent service he provided".
