In the late 1950s and early 1960s Mr Walker was exposed to asbestos when he worked for the British Electric Authority (BEA) and then the Central Electricity Generating Board (CEGB) at Kingston Power Station, Kingston, Surrey.
Around October 2016, Mr Walker began to experience breathlessness and loss of appetite. During a hospital check-up, he received the news that he was suffering from mesothelioma. He contacted Andrew Morgan at Fieldfisher for advice.
Andrew saw Mr Walker at his home to take a statement and to explain the process of making a claim. He undertook a detailed investigation into the tasks carried out by Mr Walker in his various roles and quickly established that, while he may have come into some contact with asbestos at other companies, his job at Kingston Power Station, when employed by BEA/ CEGB, was the most likely cause of his mesothelioma. In this employment he had been required to remove asbestos coverings from pipes bare-handed and to clean up the dust that accumulated on the floor when he and others undertook such work.
Mr Walker worked for several companies before he retired aged 70. Although he worked in the power generating industry throughout most of his working life, his roles varied significantly, and were largely supervisory in later years. The question remained whether asbestos exposure during his work at Kingston was so substantial that any exposure in subsequent years made no material contribution to the overall risk of his developing mesothelioma. In fact, Mr Walker was entitled to full compensation either way, because this exposure had made a material contribution to his illness, but he was happy to assist his employer in seeking contributions from later employers in exchange for an early full value settlement.
Only three months into the case, Andrew was able to reach a full value settlement for Mr Walker.
