Andrew Morgan successfully settled a claim in life for a client, who was exposed to asbestos while working for British Rail.
John* was born in 1943. He enjoyed a healthy and fit lifestyle. But in 2022, he began experiencing shortness of breath.
A chest X-ray revealed two litres of fluid around his right lung. He was diagnosed with mesothelioma, presumably as a result of exposure to asbestos.
John had joined British Rail in 1959 as an apprentice. Because of his skill working with wood and metal, he began in the construction of railway coaches. The coaches were sprayed with blue asbestos to create insultation roughly one inch thick on the inside of the metal shell.
John had to clear away asbestos with his hand to gain access to the underlying metal frames to which he would attach woodwork and metal work. He also used to drill straight through the metal floor into layers of asbestos insulation. He was not given any protective equipment or warnings.
Once instructed, Andrew made a claim to British Rail and obtained an early admission of liability and an interim payment to meet John's care needs.
Andrew was on the point of issuing court proceedings when British Rail made a full value settlement offer of £170,000 which John accepted.
Counsel was not involved.
