Mother loses hand following negligent surgery at Broomfield Hospital

Ms B, a new mother, instructed Christina Gardiner to pursue a claim against Mid Essex Hospital Services NHS Trust following negligently offered sclerotherapy to treat arteriovenous malformation (an abnormal connection between arteries and veins, bypassing the capillary system) which eventually resulted in her having to have her hand amputated.

The original operation, in addition to being negligently offered, was also negligently performed and Ms B suffered acute deterioration and rapid progression of symptoms in her hand, with infection and ischaemia.

Christina argued that but for the sclerotherapy, Ms B would have avoided the period of prolonged significant pain that she suffered, with the need for multiple hospital admissions for infection, repeated painful dressings, strong analgesia, surgical debridements and sequential amputations.

Ms B suffered excruciating pain, spent a lot of time in hospital and was unable to care for her baby daughter. The amputation of her hand finally ended the pain, but this did not change the fact that for more than a year, Ms B experienced agony in relation to her hand, and compensation was owed.

Christina constantly negotiated with the Trust, on each occasion forcing them to concede further, ultimately resulting in a final settlement of nearly five times that initially offered.

Mrs B and her family said they were incredibly grateful to Fieldfisher, and particularly Christina, who guided and advised the family throughout the extremely traumatic period.
