Jonathan Zimmern secured a £275,000 settlement following negligently performed gynaecological surgery at University College London Hospital.
Amelia* had a long-term health condition that made the skin and tissue in her body more delicate, but she was otherwise well and active. In 2019, she was told she had a cyst in her vaginal area and was referred for surgery to have it removed. Unfortunately, during the operation, a muscle that controls the bladder was severely damaged. Amelia was sent home with a catheter, but when it was removed, she found that she was incontinent of urine. She had not been warned that this was a possible risk or indeed that the size and location of the cyst made it quite likely.
She returned to hospital for a repair operation, but it was cancelled because she developed an infection. During that visit, further tests showed the damage had caused other parts of her body to weaken, and her bladder had started to drop down into her vaginal area. A second attempt at surgery was unsuccessful. She was eventually told she would need open surgery, but there was no guarantee it would work.
Since the original operation, Amelia has lived with constant bladder leakage. She lost her job as a part-time nanny and has been unable to return to the active life she once enjoyed. She can’t walk far without leaking urine, struggles with everyday tasks and has to plan every outing around access to toilets and spare clothing.
Jonathan worked closely with Amelia to understand the full impact of what had happened. He obtained expert evidence from a Urogynaecologist who confirmed that Amelia had not been properly warned about the risks of the surgery and that the damage she suffered could have been avoided. The Defendant Trust initially denied liability. However, after expert evidence was exchanged between the parties, the case proceeded to a settlement meeting.
Amelia was very happy with the outcome and said:
