Provisional damages settlement against multiple employers
Abby Bennett acted for Mr R following his diagnosis of pleural thickening.
Mr R had an extensive work history and was exposed to asbestos throughout his employment with various companies, including as an apprentice at Z D Berry & Sons Limited and as a fitter with C J Jefferies Limited, Freeman Heating Co Ltd and A G Manly Ltd. He came into contact with asbestos whilst removing old lagging and working in the vicinity of others who lagged the new pipework.
Mr R contacted Fieldfisher in January 2025 after suffering from breathlessness for several years. His complex medical history led to complications surrounding his diagnosis and Abby Bennett instructed a respiratory consultant to review Mr R's medical records and produce a report.
Court proceedings were lodged immediately to protect the client's position and Abby Bennett swiftly secured a settlement offer on a provisional basis and sought a Court Order which will allow Mr R the right to return for further compensation should his current condition deteriorate or should he go on to develop another asbestos related disease.
