Recovery for short asbestos exposure for Whitbread brewery worker
Andrew Morgan successfully settled a claim for a client, who was exposed to asbestos while working as a cellarman for brewers Whitbreads.
Tony* sustained focused exposure to asbestos on only one occasion when he had to tease open and then repair asbestos lagging that had been jury-rigged to protect a long run of a beer line in a cellar that was, unusually, heated.
He was exposed for no more than a few hours in around 1968. He also sustained generic low-level exposure when visiting a variety of licenced premises in the 1960s.
Sadly, Tony died before proceedings were brought. We pursued the case for his wife.
We obtained a report from Consulting Engineer Chris Chambers, who said this insulation was more likely than not asbestos because it was grey and crumbly.
Reports were exchanged and the case listed for trial in January 2024.
Andrew obtained a statement from a further witness who would himself have been too ill to attend trial. Andrew applied for permission to take his evidence on commission.
Unexpectedly the Defendants made a full liability offer at this time, less than three months ahead of trial.
