Settlement for young man suffering serious brain injury following collision with stolen car

A silver car with a damaged front bumper has collided with the rear side of a black SUV on a city street lined with trees.

Jennifer Buchanan and Eman Hassan settled a personal injury claim on behalf of a young man, Mr P, who suffered a life changing brain injury following a collision with a speeding stolen car.

The driver drove off without reporting the accident but was later arrested alongside three others and charged with dangerous driving causing serious injury and aggravated vehicle taking and sentenced to three years in prison.

Our client was airlifted directly to King's College Hospital and put in an induced coma. He suffered a traumatic brain injury, post-traumatic epilepsy, motor neuron weakness in his left arm and widespread soft tissue injuries. When he woke up it was obvious to his family that his personality had drastically changed.

The family instructed Fieldfisher in a personal injury claim while he was undergoing treatment and Eman and Jennifer met with them at the rehabilitation centre. A case manager was instructed early on who arranged for him to have a full rehabilitation team to be put together in the community. The family were understandably devastated by this change and the team ensured that support was provided for the family as well as Mr P as they had all been sadly affected by this accident.

Initially the claim was brought against the Motor Insurers' Bureau (MIB) as there were multiple people in the stolen car and the driver was unknown. After productive cooperation with the police, the driver was identified enabling the legal team to pursue the claim against the insurers of the vehicle and shortly after an admission of liability was secured.

Interim funds secured during the claim mean that he had the support of rehabilitation team from discharge and immediate support was put in place including securing alternative and suitable accommodation, a full MDT including a physiotherapist, occupational therapist, neuropsychologist and neuropsychiatrist, speech and language therapist, Rehab Assistants and a Personal Trainer.

A settlement agreement was reached in the sum of over £6million at a Joint Settlement Meeting prior to proceedings being issued. The damages secured for our client will fund ongoing therapy and allow him to live as independently as possible and return to as best a position as possible as he was in for but for this tragic accident.
