Seven figure settlement for civil engineer struck by uninsured motorcyclist

A city street with a zebra crossing leading to a modern apartment building. The buildings are surrounded by greenery and bare trees. The sky is clear and blue, and the streetlights are painted with black and white stripes and orange globes.

Jennifer Buchanan and Eman Hassan alongside Peter Williams secured a seven figure settlement for a young woman who was left with a life-changing brain injury after a collision with an uninsured motorcyclist.

Alice, a highly talented civil engineer in her early thirties, was struck by a speeding motorcyclist at a zebra crossing in East London, after he overtook a car that had stopped to let her walk. The driver sped off after knocking Alice down and was later convicted of causing serious injury by dangerous driving. He was driving uninsured, so a claim was brought against the Motor Insurers Bureau.

She was rushed to the emergency department at the Royal London hospital and treated for a severe traumatic brain injury, a skull fracture, and a serious hip injury.

Alice was due to sit examinations to become a chartered civil engineer a few months after the crash. She had a promising career ahead of her and was an outgoing, sociable young woman who embraced life.  All of that changed the day she was hit.

A full multidisciplinary team was assembled by the case manager to support Alice with her rehabilitation and recovery including:

  • Neuro-physiotherapy
  • Occupational therapy
  • Speech and language therapy
  • Neuro-psychology
  • Neuro-psychiatry
  • Support from Rehabilitation Assistants

Eman and Jenny also secured alternative and more suitable accommodation for Alice who had previously been living in a studio flat that was no longer appropriate for her additional needs.

Alice continued to suffer with neck and shoulder pain, muscle tension and numbness in her hands and feet and dizziness. Since the accident she also suffered from a perception of loud noise in her head and ears, which makes busy places unbearable. In her new accommodation there are quiet, calm areas where she can work and rehabilitate.

If she had not been injured, Alice would likely have reached a director level now but since the accident she is not able to work as she did as she finds her spacial awareness has changed and it is now difficult to process information or multitask, she also suffers with memory loss.

In a successful round table discussion with the representatives of the MIB, Jenny and Eman alongside Leading Counsel negotiated a significant seven figure settlement.

The settlement sum reached enables Alice to continue to have ongoing rehabilitation treatment, including cognitive and occupational therapy, neuro rehabilitation and physiotherapy. Her future is now secure in terms of her accommodation and loss of earnings.

It was a pleasure to act for Alice and hope the settlement sum allows her to feel secure to find a different quality of life that she can now enjoy.

Alice said:

"Eman, Jenny and their team were there to support me during some of the toughest times following my injury. I’ll always be grateful to them for finding the right people to help me with my recovery, and for working so hard to ensure a settlement that would give me the freedom to rebuild my life."
