Six-figure mesothelioma settlement against Ford for toolmaker

Charlotte Thorpe acted for Mr S following his diagnosis of mesothelioma.

Mr S worked as a tool maker for the Ford Motor Company Ltd from 1952 until 1992. He began as an apprentice and stayed for his whole working life. He spent his time maintaining and repairing machinery within the Ford factory in Dagenham.

He was exposed to asbestos in various ways, including through using asbestos gloves and aprons. He also recalled asbestos lagging all around the factory, which was often disturbed and replaced close to where he worked. He also made clutch pads and brake linings containing asbestos. 

He described drilling and working with all sorts of materials, in a factory environment that was filthy with dust.  At times, the air was so thick with dust that he couldn't see his hand in front of his face. Because the factory was open plan, any department working with materials including asbestos spread the dust, making it impossible to avoid inhaling it.

Ford did not warn Mr S of the dangers of asbestos exposure, nor was he given a face mask or any personal protective equipment.

Mr S started to feel breathless and hospital investigations including a biopsy led to his diagnosis of mesothelioma.

Charlotte went to visit Mr S at his home to take a detailed statement from him regarding his work history and exposure to asbestos. She was then able to prove that Mr S had been negligently exposed to asbestos by Ford and obtained an admission of liability plus an interim payment for him.

Charlotte also obtained supportive medical evidence for the claim, with the medical expert agreeing that the work Mr S performed for Ford caused his illness.

Unfortunately, Ford's insurers were slow to respond to correspondence, so to ensure that the case progressed swiftly, Charlotte issued court proceedings against the company.  The case was scheduled to appear before a judge to decide the level of damages to be awarded to the Mr S.  Meanwhile, Charlotte gathered evidence to demonstrate his losses as a result of his diagnosis and reduced life expectancy. Very sadly, Mr S passed away just days before trial.

The claim continued on behalf of his Estate and Charlotte settled the claim for a six figure sum several weeks after the trial had been due to take place.

This was a relief for Mr S's grieving family and children, who wanted justice for their father.
