Successful settlement against Deliveroo for woman hit by cyclist

Eman Hassan has won a settlement for a woman who was hit by a cyclist.

Olivia was walking to the local shops in east London when she was hit from behind by a cyclist who was riding on the pavement and using his phone. She was knocked off her feet onto the ground and landed on her back, the cyclist who was over her, she saw he was wearing a turquoise Deliveroo helmet. 

She was taken to Royal London Hospital the next day after a night of extreme pain and an X-ray revealed she had a broken femur. She spent four days in hospital and had surgery to insert metal rods into her leg.

Olivia can no longer tend to her garden, which has always been a passion, or go on long walks – something that benefitted both her mental and physical health.  She is traumatised by the accident and is deeply upset that she has lost her physical independence.

Olivia instructed Fieldfisher to pursue a personal injury claim as she was certain the cyclist had been working for Deliveroo. Under UK law cyclists are not required to have insurance, so Eman made the bold decision to pursue Deliveroo for damages.

What followed was months of forensic investigation of CCTV footage of the area from the day of the accident and site visits to gather more evidence. Eventually Eman found a CCTV clip that showed a pedal bike in the corner of the frame with a turquoise delivery box on the back which supported the fact that the cyclist worked for Deliveroo.

She presented this to Deliveroo, who initially agreed to interim payments to assist with Olivia's physical and psychological treatment.

Then, after a lengthy battle, the food delivery firm agreed on a settlement figure to provide support for Olivia into the future following the nasty injuries she suffered. Olivia is now undergoing rehabilitation therapy and is determined to regain her independence.
