Visa extension and rehabilitation secured for tourist injured in serious crash

Eman Hassan settled the claim of a young man who was visiting London from Brazil with his partner when he was thrown from a motorbike in a collision with a car.

Mr M was riding the motorbike in northwest London when a car pulled out of a side turning and drove into him, causing serious injuries. He was rushed to the Royal London Hospital by ambulance, where he remained an inpatient for over two months.

He required multiple surgeries for his severe injuries, which included damage to his shoulder, pelvis, and knee, and he also suffered a psychological injury from the crash.

Mr M instructed Eman while he was in hospital, and she made a claim against the motorist's insurers. As he does not speak English, Eman arranged for a translator at each meeting and for every document and email to be translated into Brazilian Portuguese.

He had one month left on his tourist visa at the time of the accident, so Eman involved Rhona Azir and Hannah Gibson from Fieldfisher's Immigration team from the start. They successfully negotiated an extension for Mr M and his partner to enable him to continue rehabilitative treatment.

During the claim, interim funds of over £130,000 were secured, which covered an inpatient stay at Remedy rehab clinic, where he was transferred directly from the Royal London Hospital. The defendants agreed to fund ongoing outpatient therapies, including psychology, physiotherapy, and occupational therapy.

As tourists, Mr M and his partner did not have the right to rent in the UK, so they faced a dilemma when it was time to leave the rehab inpatient clinic. Fortunately, Eman and the team arranged for them to stay at an Apart Hotel, which was paid for with the interim funds.

Visitors to the UK are not eligible for free NHS treatment, and while he was in the rehab centre, Mr M was hit with several bills for his hospital care. Eman negotiated with the defendant's legal team, and they agreed to take on the charges and reimburse the NHS on Marcos's behalf.

Whilst liability investigations were ongoing, the Defendant made a settlement offer, which was happily accepted by Mr M, as he was keen to return home to his family. Inclusive of the interim funding for his rehab and NHS reimbursement, he was awarded a life-changing sum which will enable him to access the best possible rehab care in Brazil.

After the settlement, Mr M thanked Eman for her hard work. He said:

"You were the most important person in this story. I will never forget you. I would like to always be in touch with you. I would like you to come to Brazil someday. I hope one day to repay what you have done for us. You have my eternal gratitude."
