Vital evidence confirms asbestos dust in Liverpool new housing builds

Bridget Collier successfully concluded a claim for client Graham Swift after he was diagnosed with diffuse pleural thickening.

Mr Swift was exposed to asbestos while working as a commercial painter and decorator. He had long-term service, only working for a couple of employers during his career. He remembered working on various housing estates in the new town of Skelmersdale near Liverpool for WG Lloyd Decorators Ltd.

Asbestos panelling had been used throughout the houses so that when Mr Swift prepared and painted the asbestos soffits, gutters and insulation boards under the window panels, lethal asbestos dust had covered his clothes.

In addition at that time, Artex contained asbestos and just the process of mixing it for use sent clouds of t dust into the air around Swift. Bridget was able to find online photographs of the different grades of houses on the estates, which undeniably established that asbestos was present.

Later, Mr Swift worked for W V Jackson Ltd, which then merged with Jackson Lloyd Ltd, refurbishing pubs around the Liverpool St Helens and Manchester areas. He also worked in factories containing corrugated asbestos roofing from which he would have to brush away dust before painting them. We managed to find witnesses who   confirmed that all the tradesmen involved worked furiously to finish each contract and move onto the next job. Meanwhile, dust would be flying around from the asbestos insulation used in the refurbishments.

Bridget's skill in searching for and finding evidence and witnesses was key to this case.

Sadly we could only trace insurers responsible for some of Mr Swift's employment. In any claim involving diffuse pleural thickening, compensation tends to be paid pro-rata. However, a vital part of Mr Swift's compensation was a guarantee that if he develops a further  asbestos disease, he can claim for additional more compensation.
