The child was profoundly disabled with mixed spastic/dyskinetic quadriplegic cerebral palsy.
The claim was brought against East Lancashire Hospitals NHS Trust for failure to respond swiftly to an abnormal CTG trace which had become pathological during the course of the labour. There were various missed windows of opportunity within which the claimant could and should have been delivered. Medical evidence obtained confirmed that, had the baby been delivered sooner, their brain injury would have been entirely avoidable.
The claimant lives with significant learning difficulties but is able to express their wishes and communicates using a specialist communication device. They attend a special-needs school, present with behavioural problems and suffer from disturbed sleep. They are wheelchair dependent and rely on carers to assist with all activities of daily living.
The settlement funds alternative adapted accommodation, occupational therapy, hippotherapy, speech and language therapy, physiotherapy and hydrotherapy and provides 24 hour care.
