The Regulation (EU) 2025/40 on packaging and packaging waste has been published

Regulation (EU) 2025/40 on packaging and packaging waste was published last January, which aims to address the generation of packaging waste by harmonising existing legislation in the Member States.

The main objectives of the regulation are:

  1. The prevention, reuse and reduction of waste.
  2. The promotion of the circular economy.
  3. Increasing recycled material in plastic packaging.
  4. Harmonisation of labelling.

This Regulation enters into force on 11 February and will take effect from 12 August 2026. It will be important to pay attention to the interaction between this Regulation and Royal Decree 1055/2022 of 27 December on packaging and packaging waste, which is currently applicable in Spain.

Draft amendment to Royal Decree 1345/2007 of 11 October 2007 regulating the procedure for the authorisation, registration and conditions of dispensing of industrially manufactured medicinal products for human use

Public consultation is currently open for the draft amendment of Royal Decree 1345/2007, which regulates the procedure for the authorisation, registration and conditions of dispensing of industrially manufactured medicinal products for human use.

The amendment is intended to:

  1. The inclusion of new entities from which wholesalers or incumbents may supply the deactivated unique identifier, as provided for in the regulation, in order to adapt the supply to the specific conditions of these entities.
  2. Clarification of the functioning of the SNSFarma Node, specifying what information the Node is to receive and its articulation and integration with the national repository.

The deadline for contributions expires on 15 February.

Commission launches public consultation on Critical Medicines Act

On 30 January, the European Commission launched a public consultation on the legislative text of the Critical Medicines Act, which aims to improve the supply chain for critical medicines. This proposal will complement the reform of EU pharmaceutical legislation.

The deadline for contributions expires on 27 February.
