Jamie Green secured a six-figure settlement for Brian* in his claim against Ramsay Healthcare following negligent errors before and during a hip resurfacing operation performed by Jeremy Parker, who has since been struck off the General Medical Council (GMC) Register for his treatment of Mr Johnson and other patients.
Brian developed pain in his left hip and was sent by his GP for X-rays, which suggested signs of impingement. He was referred to see Mr Parker who performed MRI scans of the hip. A diagnostic injection was trialled but provided limited relief, so Mr Parker offered Brian the option of undergoing a hip resurfacing procedure, a cemented hip replacement or a non-cemented hip replacement. He was not appropriately consented for the procedure and was not told about the risks and benefits of the two hip replacement options. In light of what he was told, Brian agreed to undergo a hip resurfacing procedure.
During the procedure, Mr Parker negligently failed to ensure that enough anteversion (a forward rotation in the femur) on the acetabular cup was achieved and failed to remove osteophytes on the femoral neck. This in turn led to further and ongoing impingement in Brian's left hip which was debilitating.
Despite Brian being in agony post-surgery, Mr Parker reassured him that the surgery had gone as planned.
In the months and years that followed Brian continued to suffer from severe and debilitating hip pain. His hip and leg would lock every time he bent down and he needed significant levels of pain medication to cope. His mental health deteriorated due to his pain and reduced mobility, and he was unable to walk for long periods, which caused him to develop chronic back pain.
It was only four years post-operatively that it was discovered that Mr Parker had negligently performed the original surgery and this was subsequently corrected. While Brian is pain-free now, he has had multiple surgeries that he otherwise would not have needed and will need further surgery in the future to replace his hip.
Once instructed, Jamie obtained a report from an Orthopaedic Surgeon who concluded that the surgery performed was negligent and was the cause of Brian's ongoing pain and discomfort.
Jamie subsequently wrote a Letter of Claim to Ramsay Healthcare, which admitted liability. Jamie then instructed a Physician, Psychiatrist and Orthopaedic Surgeon to comment on Brian's injuries and his long-term prognosis, to quantify the claim.
During negotiations, Jamie secured a six-figure settlement for Brian.
In early 2023, the GMC concluded that Mr Parker's fitness to practise was impaired by reason of misconduct and he was struck off the register.
