Simon's brain injury has a profound affect. He suffers with an organic personality disorder because of the injury, cognitive impairments and depression.
Simon's presentation is complex and challenging with impaired insight and judgment with rigid, impulsive, disinhibited, and immature behaviour. As a result, he is an extremely vulnerable individual needing a high level of supervision to ensure he can live independently and safely.
Expert evidence has been required in neurology, neuropsychiatry, neuropsychology, orthopaedics, rehabilitation medicine, accommodation, life expectancy and care. A key issue in the case is the need for 24/7 care which was disputed between the various experts.
Despite liability having been admitted in full, the Defendants only made settlement offers less than two months before a 10-day assessment of damages hearing.
Despite the resistance of the Defendant's in respect of quantum, Keith Barrett and his team have secured multiple interim payments, including funding for an independent living trial and a MDT overseen by a highly experienced brain injury Case Manager to help with Simon's rehabilitation needs.
Settlement of the claim was approved by a Judge sitting in the High Court in Manchester in March 2023.
