On 25 June, the European Commission published its draft of an ambitious new Act that seeks to harmonise space regulation across all EU Member States, whilst addressing the key focus areas of safety, resilience, and sustainability.

This will bring a whole new regime to the space sector, impacting not just EU based space business but also US, UK and other non-EU space businesses who have commercial dealings with Europe.

Fieldfisher's market leading Satellite and Space Projects team has prepared an initial briefing, which includes insights on the following points:

  • How will space services, for EU operators and third country (non-EU) space businesses, be authorised/registered?
  • What does the Act mean for European national space regulation?
  • What is the approach to sustainability, safety, cyber security and resilience requirements?
  • What do businesses need to do in light of the proposal?

Our initial commentary addresses the most significant issues arising from the Act and a range of short- and longer-term action points for space businesses across the globe.
