Fieldfisher advises EEF on the acquisition of Beckum wind farm

The Fieldfisher Energy team led by Daniel Marhewka advised EEF Erneuerbare Energien Fabrik GmbH (EEF) on the acquisition of the Beckum wind farm. The wind farm has a planned total capacity of 21.9 MW and comprises three Nordex N149 turbines with a hub height of 125.4 metres and a Nordex N133 turbine with a hub height of 110 metres. The wind farm was sold by BayWa r.e.

EEF Erneuerbare Energien Fabrik GmbH (EEF) is driving the energy transition 2.0 by using digital and AI-supported technologies to develop and integrate holistic energy concepts that work both regionally and nationally. Through hybrid parks that combine wind, solar, storage and conversion technologies, EEF creates efficient energy systems that secure the future of our energy supply.

With the acquisition of the Beckum wind farm in North Rhine-Westphalia, EEF is taking over all outstanding development tasks and is fully responsible for project realisation and construction of the wind farm. The project received the required permit under the Federal Immission Control Act (BImSchG) in October 2023 and an EEG surcharge in March 2024. To ensure a smooth and efficient handover, the already successful collaboration between BayWa r.e. and EEF will be extended and continued through a joint handover phase as part of the transaction. Construction is planned to start immediately after the transaction is completed, with earthworks scheduled to begin at the start of November 2024. During the construction phase, EEF will work closely with local authorities and communities to ensure that the work is carried out in compliance with all environmental and safety standards. The wind farm is expected to be completed and operational by the first quarter of 2026 at the latest.

In the future, the Beckum wind farm is expected to generate 46,000 MWh of green energy per year, enabling the supply of renewable electricity to around 15,000 households per year. From 2026, the wind farm will thus make a significant contribution to achieving climate targets.

Fieldfisher provided comprehensive legal advice to EEF on this transaction. The advice included, in particular, the design and negotiation of the acquisition documentation and the execution of a due diligence review of the wind farm.
