New era for economic crime enforcement against corporates in the UK: How hostile will it be?

On 26 December 2023, the U.K. Government brought into force the most significant change in corporate criminal law for decades, with the stated aim of making it easier for law enforcement to prosecute companies for economic crime.

Now, from 1 September 2025, a new criminal offence will be in force, which paves the way for prosecuting companies for failure to prevent fraud by persons associated with them, representing a significant expansion of the existing failure to prevent model, which already applies to bribery and the facilitation of tax evasion.
