The firm's Competition team obtained the first decision in the electric mobility sector from the French Competition Authority, in a matter concerning the creation of a joint venture active in Guadeloupe (GMOB project).
A very satisfactory decision was obtained on Friday 1 October by the Fieldfisher Paris competition team, following a lengthy notification process which resulted in the Authority's first decision in the emerging electric mobility sector, as mentioned in its press release (ADLC press release ).The operation concerns the creation of a full-function joint venture (GMOB) by several operators (EDF PEI, AGI, SAFO and GENAK) whose activity is the deployment and operation of a network of recharging stations for electric vehicles, for professional and domestic customers, in the French overseas department of Guadeloupe.
Due to the presence among the founding companies of groups working at a European level, the project initially had a European dimension, before the latest developments related to the Brexit removed this.
The team then turned to the French Competition Authority, whose decision-making practice in the electric mobility sector was under construction. A notification process then began, during which the team had to convince the Authority in several respects.
The main difficulty was that the Authority had not itself examined the delimitation of the markets concerned by the transaction, which led the team to propose market definitions derived from European practice (in particular from the Commission's E.ON/Innogy decision of 17 September 2019).
