Our team specialises in European Union and Competition Law and regularly assists public bodies and companies in interpreting and applying antitrust rules before the various European and national authorities (the European Commission's Directorate General for Competition, the National Commission for Markets and Competition and the various authorities of the Autonomous Communities). We work closely with Fieldfisher's network of offices across Europe to provide cross-border advice.

Private enforcement of antitrust rules

We advise our clients in relation to the private enforcement of antitrust rules, especially in relation to antitrust damages actions.

We advise on national and European antitrust law, including advising on restrictive agreements and practices, both on a preventative basis and in administrative and judicial proceedings.

We carry out internal audits to verify compliance with Spanish and European antitrust regulations.

Control of foreign investments and control of foreign state aid

We assist our clients in the understanding of the scope of application of the rules on the control of foreign investment in Spain and the control of foreign state aid by the European Commission. If necessary, we prepare the corresponding application for authorisation and assist in managing and processing the administrative file.

Design and adaptation of commercial contracts

We analyse the impact of competition law on commercial contracts, both distribution and commercial cooperation. We provide legal certainty to companies.

We offer in-house training programmes for companies, focusing on competition regulation and its impact on the competitive structure of companies.

Notification of business concentrations

We advise companies in the process of merging businesses to determine the existence of a notification obligation and, where appropriate, to structure the operation so that it complies with the antitrust rules (especially regarding the obligation to suspend). Where necessary, we handle the process of notifying and filing mergers with the Spanish and European Antitrust Authorities.

Unfair Competition

We advise and defend our clients in cases of unfair competition, protecting their commercial interests.
