What is an Acquired Child Brain Injury?
An acquired child brain injury is different from a brain injury sustained before, during or immediately after birth, generally caused by delays in delivering a baby in distress.
An acquired brain injury is usually caused by an accident, for example, a collision on the roads, or by medical negligence by GPs or hospital staff who fail to recognise and react to a serious illness
Our medical negligence and personal injury solicitors specialise in both birth injury and acquired brain injury.
Types of Acquired Child Brain Injury compensation claims
Acquired brain injuries in children are most commonly caused by:
- A road traffic accident, for example being hit by a vehicle when crossing the road or while riding a bicycle.
- E-scooter accidents.
- A fall.
- Sports injuries, including team sports such as football and rugby.
- Medical negligence, often involving a missed or delayed diagnosis of a serious illness such as meningitis or sepsis that results in brain injury.
Personal injury and medical negligence claims involving an acquired brain injury are investigated in different ways. Personal injury claims generally involve a defendant insurer of a vehicle or public space whereas medical negligence claims for acquired brain injury will usually involve a hospital trust or private practitioner.
As with birth injury claims, we are expert in intervening quickly and efficiently to engage with defendants to claim interim funds to pay for ongoing medical care and rehabilitation.
Most claims will also include the cost of carers, adapted accommodation and specialist aids and therapies such as speech and language therapy. We will usually instruct a case manager to liaise with the family to ensure the right care is in place quickly.
Research shows that timely intervention in acquired brain injury cases has enormous impact on a person's recovery.
How much compensation can I claim for my child's brain injury?
Compensation for acquired brain injury depends on the type of injury and the cost of caring for the injured child, often for life. Most of the compensation claimed is for the costs to help the child as far as possible lead the life they would have had they not sustained a brain injury.
These costs include for carers, therapies, adapted accommodation, equipment and other financial costs. If these needs will be life long, compensation will be calculated to meet the costs for the rest of the child's life.
We specialise in commissioning expert medical evidence to assess a child's injury and their prognosis to calculate the appropriate compensation to seek on your child's behalf.
When the case is won, we also advise on the creation of trusts and have a dedicated Court of Protection team to manage the affairs of children.
