Construction a Year in Review – 2022

In this review of key construction industry developments from 2022 we start by looking at some of the big issues affecting the sector.

We mention the construction playbook which was put forward at the end of last year, but also Brexit given its ongoing impact. As we could not review 2022 without also highlighting the continuing construction materials and labour shortages – which also featured in our review of 2021, we update you on those too.

We highlight some of the most important cases decided last year for our industry including Buckingham Group Contracting Ltd v Peel L&P Investments and Property Ltd [2022] EWHC 1842 (TCC), Sudlows Ltd v Global Switch Estates 1 [2022] EWHC 3319 (TCC) and Abbey Healthcare (Mill Hill) Ltd v Simply Construct (UK) LLP [2022] EWCA Civ 823, in which a decision of the Supreme Court is expected this year and which will have considerable implications for construction disputes where a claim is being brought under a collateral warranty.

There are, of course, positives, such as the work our firm is doing as part of the Chancery Lane Project and we round off by taking a look at some of the most significant new Regulation affecting construction, including the Building Safety Act 2022 and work being done to try to simplify the Civil Procedure Rules as well as briefly looking ahead at what 2023 holds in store.
