In recent years we've seen how increasing integration of AI into the healthcare sector is revolutionising the way medical technologies operate. MedTech companies are embedding AI into their solutions to enhance diagnostics, treatment planning, and patient care.

As this technological transformation unfolds, ensuring the safety of AI models in healthcare becomes a paramount concern. Chris Eastham, Technology and Data Partner at European law firm Fieldfisher, explores some challenges and opportunities facing MedTech companies as they integrate AI into their offerings, emphasising the importance of proactive governance frameworks, regulatory compliance, and risk management.

Collaboration between government and business

The assurance processes needed for AI models in healthcare are likely to be characterised by more collaboration between government and businesses. As MedTech companies strive to innovate and meet the evolving healthcare needs of a changing population, it is essential for them to work in tandem with regulatory bodies to establish robust safety measures.

Governments worldwide are recognising the potential of AI in healthcare and are actively engaging with businesses to create a regulatory environment that fosters innovation while safeguarding patient well-being. In the UK there have been a series of announcements of funding for AI projects for the healthcare industry, with the latest being the creation of a £100 million fund announced at the end of October 2023.

This was followed by the AI Safety Summit where 29 governments signed the ‘Bletchley Declaration’, underscoring the UK's commitment to be proactive in working together to develop the uses of AI. A key output of the summit was tech companies agreeing to work in partnership with the government to test AI solutions, showing the shared desire to drive this technological shift.

The regulatory landscape in the UK and Europe

As MedTech companies embed AI into an increasing number of solutions, they must have an eye to the evolving regulatory landscape in both the UK and Europe, and beyond. Regulators are closely scrutinising the implementation of AI in healthcare, recognising the need to establish clear guidelines and standards. Non-compliance with these regulations can carry severe consequences and organisations should prioritise accordingly.

While the prospect of increasingly stringent regulation may be daunting, it is not to be feared. Well-developed regulatory frameworks will bring more certainty to the MedTech space and provide a more stable foundation for innovation. Companies that proactively align their AI solutions with evolving regulations can gain a competitive advantage, showcasing their commitment to ethical practices and patient safety.

Addressing the multifaceted risks of AI integration

Whilst the predominant focus on AI in healthcare should undoubtedly be safety, businesses should not overlook other critical risks associated with AI integration. Unwanted disclosure of confidential information, data protection non-compliance, intellectual property infringement, and challenges in protecting new developments, among other risks, pose ongoing challenges for MedTech companies.

These risks deserve the attention of business leaders as they shape their strategic approaches to artificial intelligence. MedTech companies must adopt a holistic approach to AI integration—addressing data protection, intellectual property, and contractual risks etc. will be essential for ensuring the long-term success and sustainability of AI-driven healthcare solutions.

MedTech companies should be proactive in developing AI governance frameworks. By building these frameworks now, companies can ensure they are well-prepared for a dynamic global regulatory landscape, whilst simultaneously fostering a culture of responsible innovation.

A call to action to drive the AI healthcare revolution

As MedTech companies continue to embed AI into their solutions, the interplay between government and business, the evolving regulatory landscape, and the multifaceted risks associated with AI integration must be carefully navigated. Proactive development of AI governance frameworks, alignment with regulatory requirements, and a comprehensive approach to risk management are critical for ensuring the safety, integrity, and success of AI-driven healthcare technologies. By embracing these challenges, MedTech companies can position themselves as pioneers in responsible innovation, contributing to the transformation of healthcare through the power of artificial intelligence.
