I deal with a broad range of commercial property issues, including business lease renewals, dilapidations, break notices, recovery of arrears or tenant insolvency, as well as real property disputes such as covenants, easements and boundaries and site protection injunctions.

I act for various clients from developers to investors, administrators and occupiers and for a variety of sectors including real estate, retail, energy or local authorities. I advise both landlord and tenant clients in managing large property portfolios on a wide range of issues and also assist on complex standalone disputes. I also regularly provide strategic advice to clients on large transactions in conjunction with transactional, construction and planning colleagues.

My experience includes:

  • Acted for an energy operator in respect of the first of its kind pre-emptive injunction against persons unknown;
  • Acted for an investor-developer in a claim against a tech-based management company;
  • Acted for an aerospace manufacturer in a multi-million pound claim against its former landlord regarding the validity of a notice to terminate an agreement for lease and subsequent claim for damages;
  • Acting for the landlord in a multi-party dispute on fire safety issues affecting a large block of high rise residential premises; and
  • Acting for the landlord in a multi-million pound dilapidations claim regarding an energy plant.

Pre-emptive site protection injunctions: Preparing for protest

In recent years, landowners have obtained pre-emptive injunctions against 'persons unknown' to protect their sites against trespass and other unlawful obstructive acts (known as a "newcomer injunction"). Sites which have received the benefit of such protection include large development sites, university campuses, local authority land, sports venues and oil and gas sites.
