Professional background

I advise clients on the protection and enforcement of their intellectual property rights. I act for both international and domestic clients in relation to disputes on a wide range of rights including copyright (for both artistic and technology related works), database rights, trade marks, passing off, designs and domain names. This can be from initial strategic advice through to settlement and, if required, litigation.  I have experience assisting clients in various forums including the High Court, the Intellectual Property and Enterprise Court and the European General Court. I also advise clients on non-contentious matters including protection strategies for their trade mark portfolios and commercial contracts.

I advise clients across a broad spectrum of industries from the media and entertainment sectors to sporting data and public bodies.

I was the lead assistant acting for Ordnance Survey in a two-week High Court trial in its successful defence and counterclaim of a highly technical case concerning copyright and database rights and breach of contract (77m Ltd v Ordnance Survey Ltd [2019] EWHC 3007). I acted for Genius Sports in a claim for infringement of database rights against Betconstruct and others, which settled out of court in December 2022.  I am currently acting for Getty Images in a claim against Stability AI for infringement of various IP rights including copyright relating to AI generated content.

I achieved a Distinction in the University of Oxford Postgraduate Diploma in Intellectual Property Law & Practice and am a member of IPSoc (the society for junior IP practitioners) and AIPPI UK.

I am listed as a "key lawyer" in The Legal 500 UK 2021 and 2022 with the following testimonial "Miryam Boston has an eye for detail and will chase down every point. Really knows her stuff and is a great team player."

I am also listed as a Rising Star in 2024 and a Notable Practitioner in 2023 in IP Stars.

Back in November 2023, the Court of Appeal case of THJ Systems Ltd v Sheridan[2023] EWCA Civ 1354 settled any remaining debate over the correct test for the originality requirement for copyright to subsist in a literary, dramatic, musical or artistic work in the UK.
