On 19th August 2019 a spokesperson for the Home Office announced their intention to end Free Movement overnight on 31 October in the event of a no-deal Brexit.
This signals a significant shift in policy from Theresa May's government and there is no indication at this stage of whether, and how EU nationals arriving after a no deal Brexit could be employed in the UK. The abrupt ending of Free Movement is likely to cause problems for employers who will have to distinguish between those EU nationals who are eligible for the EU Settlement Scheme and those who are not, a complex task which may leave them in a precarious position if errors are made. This may be the start of further significant changes in Government policy ahead of a no deal Brexit.
